What to expect at our events, what industry may and may not do, and how to look after your own information.
Every year the board writes to the community about being an informed consumer: how to tell one of our events from an industry one, what a manufacturer is legally allowed to give you, and why your contact details are worth guarding.

Dear Bleeding Disorders Community Members:
The Lone Star Bleeding Disorders Foundation is providing this information to educate you and your families on your rights and responsibilities as a member of the bleeding disorders community. This communication is intended to provide you with information to help you be an informed and responsible consumer. We ask that you please take the time to read this detailed letter and share it with your family. It is important.
Lone Star vs Non-Lone Star Events
You may have been invited to attend education events and dinners recently by both The Lone Star BDF and others. It can be confusing as to who the host organization is and what the intent of the meeting is. Know that if the invitation is coming from Lone Star, the Lone Star logo will be displayed and an RSVP request to the chapter will be included. (There are times that Lone Star BDF partners with a treatment center, and the treatment center may request rsvps as well.) When attending a Lone Star organized event you can expect the following:
- Educational materials have been vetted by Lone Star staff and determined appropriate and meaningful.
- One-on-one (high pressure) sales and marketing efforts by industry partners is not permitted.
- Lone Star Staff and/or Board members will be present to ensure all participants are treated respectfully and appropriately.
When you attend non-Lone Star sanctioned events organized directly by industry, the expectations above are no longer assured. These non-chapter events are designed to provide an opportunity to showcase and sell products and to encourage you to switch to new products and services. Attend if this is of interest to you. Please remember that changing products and services is a very personal decision. We encourage you to discuss any changes you would like to make with your doctor to determine the best solutions for your healthcare needs. Be aware if you feel you are being pressured or being provided incentives (items, activities or monetary incentives). If you feel you have experienced ongoing pressure from attending any events, you may wish to take the following actions:
- You should never be required to provide your full name, address, phone, or email address. If you do, remember you will be contacted by the Company in the future.
- If after providing information to a company you feel you are being contacted too often or inappropriately, communicate with the company or individual you are concerned about. You can ask them to stop contacting you. This will likely solve the problem immediately.
- If pressure continues, please call your Treatment Center or the Lone Star office. We will do what we can to help mediate a solution.
- Do not take information received at face value, be sure to do your own follow-up research.
- Ask for written documentation from home care and manufacturers to substantiate any claims.
Personal Health Information (PHI)
If you are invited to events that are not Lone Star BDF sanctioned, you may have previously provided your contact information to the invitee. This may have occurred at a past event, online or via surveys. You and your family are responsible for the protection of your own personal health information (PHI). You have the right to not provide your contact information or PHI at these events.
Insurers, health care providers and pharmacies are required to keep your information confidential and to inform you of a security breech (HIPAA). The Lone Star BDF takes this very seriously and does not sell or share any information with manufacturers, home care providers or market research firms. Non-covered entities (market research, manufacturers) don’t have to abide by HIPAA guidelines. If you share your information you will likely be contacted (phone calls, email or mail). This is true regardless of who you share it with (internet surveys, grocery stores, raffles etc.) Your challenge is to find out what is done with your information and to choose wisely when you share it!
- Ask for privacy policies before sharing – understand what will be done with your information.
- Information privacy pertains to all exchanges of personal information – not just bleeding disorders.
Consumers/Patients also need to be careful sharing their information with other consumers/patients. You should sign up directly with the Foundation to stay informed about events and other resources available to you.
Lone Star Position Regarding Manufacturers and Home Care / Specialty Pharmacy Providers at Chapter Events
It is important that we invite Manufacturers and Home Care to our Lone Star events. They are conducting business at these events and we can expect them to engage respectfully. Manufacturers provide information on products, their programs such as factor assistance, recalls, and scholarships and advocacy. Home Care or Specialty Pharmacies provide information about their pharmacy services and programs or support services they have. You should ask questions to learn more about these companies and how their products or services will meet your needs.
Legal Obligations for Industry
The Office of the Inspector General (OIG) regulates the behavior of manufacturers and homecare/specialty pharmacy providers through advisory opinions. There are legal obligations of our industry providers that regulate how industry interacts with doctors, nurses and other health care providers. Manufacturers also cannot give items or support of any monetary nature directly to patients or potential patients.
The OIG also has regulations specifically around bleeding disorders also known as Opinions. These provide healthcare providers and suppliers a better understanding of the provisions of the federal Anti-Beneficiary Inducement Regulation. It provides information on what a home care provider can provide to bleeding disorders patients. Items of “nominal” value do not violate the federal Anti-Beneficiary Inducement Regulation and the Anti-Kickback Statute. The limits of “nominal” value are set at $10 per individual item and no more than $50 worth of items per individual per year. There are consequences to the home care company and to the consumer, when a law is broken. Fines of up to $10,000 per violation can be assessed for the specialty pharmacy providers or supplier. If it is determined that the Anti-Kickback Statute was violated, fines, exclusion from Medicare and Medicaid and, criminal sanctions including jail could be invoked if giving or receiving prohibited remuneration.
Your responsibilities when attending Lone Star events
Much effort and money goes into planning and holding events. If you RSVP for an event, please attend. Food and tickets are purchased and money that could be used to support our community is wasted if you don’t show up.
- If you have an emergency, please contact the Lone Star office. We can potentially cancel food and entertainment or give someone who is waitlisted an opportunity to attend the event.
- Our industry sponsors help fund these events so that they have access to our membership which enables them to do their jobs (selling products and services). Please visit their booths at our events!
- Lack of interest through low attendance could result in less funding and programs in the future.

Our goal as a board is to provide our community with opportunities for education, networking and socializing in a safe and supportive environment. Remember, you are your very best advocate, and it is your responsibility to stand up for your rights. Eventos de Lone Star frente a eventos que no son de Lone Star
Es posible que usted haya sido invitado recientemente a asistir a eventos educativos y cenas organizados tanto por Lone Star BDF como por otros. Puede ser confuso saber cuál es la organización anfitriona y cuál es el objeto de la reunión. Recuerde que si la invitación es de Lone Star, aparecerá el logotipo de Lone Star y se incluirá un pedido de confirmación de asistencia al capítulo. (Hay ocasiones en que el Capítulo Lone Star se asocia con un centro de tratamiento, y el centro de tratamiento puede también solicitar confirmaciones). Cuando asista a un evento organizado por Lone Star puede esperar lo siguiente:
- Los materiales educativos habrán sido aprobados por el personal de Lone Star, y se habrá determinado su pertinencia e importancia.
- Los esfuerzos de ventas y comercialización individuales (con mucha presión) por parte de colaboradores de la industria no están permitidos.
- El personal de Lone Star o los miembros de la Junta estarán presentes para asegurar que los participantes sean tratados con respeto y en forma apropiada.
Cuando asista a eventos no avalados por Lone Star organizados directamente por la industria, las expectativas mencionadas arriba no están garantizadas. Estos eventos que no son del capítulo están diseñados para brindar una oportunidad de presentar y vender productos y para animarlo a que cambie a nuevos productos y servicios. Asista si esto le interesa. Por favor recuerde que cambiar de productos y servicios es una decisión muy personal. Le recomendamos que hable de cualquier cambio que quiera hacer con su médico para determinar las mejores soluciones para sus necesidades de atención médica. Esté atento si siente que lo presionan o le ofrecen incentivos (objetos, actividades o incentivos monetarios). Si piensa que ha sido objeto de presión constante por asistir a cualquier evento, puede considerar los siguientes pasos:
- Nunca se le pedirá que facilite su nombre completo, dirección, teléfono o dirección de correo electrónico. Si lo hace, recuerde que la empresa se pondrá en contacto con usted en el futuro.
- Si después de facilitar información a una empresa cree que se ponen en contacto con usted con demasiada frecuencia o de forma inadecuada, comuníquese con la empresa o la persona que le preocupa. - Solicite documentación escrita de atención en el hogar y fabricantes para fundamentar cualquier reclamo.
Información Personal de Salud (PHI)
Si recibe la invitación a eventos que no son avalados por Lone Star BDF, significa que usted ha proporcionado anteriormente su información de contacto a quien hace la invitación. Esto pudo haberlo hecho en un evento pasado, en Internet o a través de encuestas. Usted y su familia son responsables de la protección de su propia información personal de salud (PHI). Usted tiene el derecho de no proporcionar su información de contacto o PHI en estos eventos.

Esto sucede sin importar con quién la comparta (encuestas en Internet, tiendas de comestibles, rifas, etc.) ¡El reto al que se enfrenta es el de descubrir qué se hace con su información y elegir con prudencia cuando la comparte!
- Solicite las políticas de privacidad antes de compartir; sepa lo que se va a hacer con su información.
- La privacidad de la información está relacionada con todos los intercambios de información personal, no solo con los trastornos hemorrágicos.
Los consumidores/pacientes también deben tener cuidado al compartir su información con otros consumidores/pacientes. Debería inscribirse directamente en el Capítulo para mantenerse informado sobre eventos y otros recursos a su disposición.
La postura de Lone Star respecto de los fabricantes y los proveedores de atención en el hogar/proveedores farmacéuticos especializados en los eventos del capítulo
Es importante que invitemos a los fabricantes y proveedores de atención en el hogar a nuestros eventos de Lone Star. Llevan a cabo actividades comerciales en estos eventos y podemos esperar que participen respetuosamente. Los fabricantes proporcionan información sobre productos, sus programas, como asistencia sobre el factor, retiros de productos del mercado, becas y promoción. La atención en el hogar o las farmacias especializadas proporcionan información sobre sus servicios de farmacia y los programas o servicios de apoyo con los que cuentan. Debería hacer preguntas para conocer más sobre estas empresas y cómo los productos o servicios que ofrecen satisfarán sus necesidades.
Obligaciones legales de la industria
La Oficina del Inspector General (OIG) regula el comportamiento de los fabricantes y los proveedores de atención en el hogar/proveedores de productos farmacéuticos especializados mediante opiniones consultivas. Existen obligaciones legales para nuestros proveedores de la industria que regulan la manera en que esta interactúa con los médicos, el personal de enfermería y otros proveedores de atención médica. Además, los fabricantes no pueden dar artículos ni apoyo de tipo monetario directamente a los pacientes o posibles pacientes.
La OIG también tiene normas específicas en torno a la hemofilia, conocidas como “Opiniones”. Estas proporcionan a los proveedores de atención médica una mejor comprensión de las disposiciones del Reglamento Federal en contra de Incentivos al Beneficiario. Proporciona información sobre lo que un proveedor de atención en el hogar puede ofrecer a los pacientes que presentan trastornos hemorrágicos. Los artículos de valor “nominal” no violan el Reglamento en contra de Incentivos al Beneficiario ni el Estatuto Antisoborno. Los límites del valor “nominal” se establecen en $10 por artículo individual y en no más de $50 por persona por año. Hay consecuencias para la empresa de atención en el hogar y para el consumidor cuando se infringe una ley. Se pueden imponer multas de hasta $10,000 por infracción a los proveedores de productos farmacéuticos especializados o a quien los suministra. Si se determina que se infringió el Estatuto Antisoborno, se podrían aplicar multas, la exclusión de Medicare y Medicaid y sanciones penales incluyendo la cárcel por dar o recibir remuneración prohibida.
Sus responsabilidades al asistir a eventos de Lone Star
Se destina mucho dinero y esfuerzo para la planificación y la celebración de eventos. Si usted confirma su asistencia para un evento, por favor asista. Se compran comida y boletos, y si usted no asiste, el dinero que se podría emplear para apoyar a nuestra comunidad se desperdicia.
- Si tiene una emergencia, por favor póngase en contacto con la oficina de Lone Star. Podríamos cancelar la comida y el entretenimiento o darle la oportunidad de asistir al evento a alguien que esté en la lista de espera.
